Tying in tub vent to downstairs vent pipe

Okay, so, I'm doing a Master Bath remodel. I removed my old tub, shower, walls etc. Going with an open plan. Now that the shower walls and tub walls/framing (picture tiled "Stadium" seating on three sides of the tub) are gone I can see that the shower and tub drains both connect to a "main" pipe and have their own vents. Both of those vents are about 1.5 ft from their respective drain. I am moving my tub across the room. The new tub drain will be 6.5 ft. from the old vent. Code says no more than 6ft from drain.

BUT...

I might be in luck. I opened up the wall around the new tub location, and see the vent pipe from the downstairs kitchen sink about 1ft away from the new tub drain location. Can I tie into this kitchen vent pipe for my tub drain vent? I can't find anything saying yes or no....

sure tie them together a min of 6 inches above overflow rim of fixture no maximum hieght
