Auxiliary condensate drain above bathtub?

Hello, I am not sure if this question has been asked and answered, or even correctly qualified by me.
I live on the fifth story of a condominium complex in Austin, Texas. The attached picture shows what I believe to be an auxiliary A/C drain located directly above my bathtub. I have noticed over the past few weeks that this regularly leaks/drips a clear fluid into the tub, and it has left a long yellow stain.

My question: Is this safe? Is it a violation of some code?

my guess is it could be a "secondary " condensate for an a/c system meaning an overflow in the event of the primary condensate drain failing to drain properly a stoppage would mean that the drain water instead comes out typicaly in an area where someone will see it and tend to the problem typicaly we dump it over a widow or doorway so you are bothered by it and fix the issue
