Stuck well pump

First time poster here, but I have been browsing the forums ever since I purchased my first home. Im having a legality issue over the water well that was servicjng the home i puchased. I suffered a lack of water condition shortly after purchasing. I called our local well professional and he informed me that he has been to the property, and there is an extensive history on the well. The casing is 4” and there is a pump stuck in the bottom of the well that could not be removed. The well professional suggested i contact a lawyer. The seller failed to mention the stuck pump he was aware about and failed to disclose it on the purchase and sale agreement where he stated the well was in good working order. Is there any well professionals in this forum that can provide some information for me? The seller states he did no wrong and that the well is ok with a stuck pump now that they dropped a new pump on top of it. The well professional says the repair of placing a new pump on top of the stuck pump was only to get the seller by until he could drill a new water well which the seller also requested quotes for. I am in the process of a small claims court case against the seller and am just looking for some professional opinions on this matter. I drilled a new well for 17,000$ which is now providing more than enough water for the property.

There are many wells with a stuck pump on the bottom. If the well can still supply enough water the old pump at the bottom of the well won't hurt anything. Only if the well will not make enough water or the old pump is in the way would you need to drill a new well. But, I would not be happy that was not disclosed.

That’s what happened in my situation. The well turned low yielding as the stuck pump eventually blocked the water from flowing past it. The well driller spent a day with some new tooling/equipment in an attempt to spear the top of the pump and drive an extractor into it to grab the pump but did not have any success. The decision was made to drill a new well after that attempt. The well company is the best in our area and I truly believe we exhausted all options prior to drilling.
