NPE-240A2 Outdoor install - Clearences

Hello - I had NPE-240A2 Outdoor installation ongoing. According to the installation manual clearance for the top seems to be 36" (Page 17 and 59 of the install doc) for outdoor install in one page and on another page, it shows soffit depth or greater (Page 50). Currently the install top clearance is at 15". I have added a couple of pictures of the installation area. It appears the installation is off based on the navien install doc. For reference, my soffit depth is around 29 inches

What are some suggestions to correct as the space appears to be tight.

Current clearance from the bottom of navien unit (from the bottom of the recirculation inlet fitting ) appears to be 45" to 46". The cold, gas and hot water connections were piped in 20" above the concrete path/inside of the garage.

To correct the top clearance, it appears we need to bring down the unit another 21" to comply with 36" clearance for inspection. If we bring it down, the unit will be very close to the water and gas pipes coming in from the garage. Concerned it will make maintenance challenging...Looking from experts here on any ideas to correct this in a manner that will help with ease of maintenance?

I called Navien tech support but they are not very helpful in confirming 36" vs. soffit depth.

Looked through a few of their manuals doesn't make sense but don't think its for service but for flue gas. There is no help from Navian for a homeowner that has a problem. Looked at Takagi T-H3M-OS-N Outdoor Tankless High Efficiency Condensing Water Heater (NG)
In the install manual they call for 36" also.

With both the combustion exhaust vent outlet and the combustion air inlet located on the top of the unit, without adequate ventilation clearance, there is an increased potential for the exhaust discharge gases becoming drawn into the air inlet.

Your photo is not clear if there are openings below the overhang, to permit air entry into the garage attic space. Any openings within 4' of either side of the exhaust vent should be closed and sealed (same as the requirement for openable windows).

The diagram you posted specifies only minimum clearance requirements. In my Province Ontario, when the device manufacturer specifies a clearance requirement that is greater than the code minimum, the device manufacturer's requirement will become the minimum clearance needed to pass inspection.

thank you all...according to Navien, all units installed outdoor should have a vent cap, so that took out the ability to run a 2"PVC vent through the roof.

Our awesome plumbing team was able to figure out and adjust the install to have more than 36" clearence. don't see a big issue. everything seems to be working well so far.

What Navien "said" is just not correct. We have a hundred instances of outdoor installs too close to windows that have exhaust vents through the roof.
