Recently I had a plumber install a new trip lever in my bath tub. With my old one I could fill the tub with as much water as I wanted. Now when the water gets to the trip lever it will drain till the water gets below the lever. Can I have the plumber install a new trip lever without an over flow or do I just have to live with it ? Also when the water goes over the trip lever and drains it is draining into a pipe that is behind the trip lever right?

Right.

I think having an overflow is the norm.

Of course, you can eliminate tubs overflow and flood the room below as it happens a lot in older buildings that do NOT have protection

OR

You can turn the overflow plate upside down and this will add about 2" more water in the tub and still have protection
