Distance between AC ducts and existing water heater

Hi folks,

I just had to replace the AC ducts in my house, after battling mold for 3 years. The new installation has the AC ducts going in front of the water heater tanks, and actually touching one of the tanks. Is this allowed? Shouldn't there be a minimum clearance between the water heater tanks and the AC ducts? Does anyone know what the Texas residential code say about that?

Is it ridged or flex ducts? Water heater tanks? (plural?). What type of water heaters gas or electric.
