Delta tub spout diverter problem

New Delta Stryke tub spout with a pull up diverter that doesn't work. Operation requires one hand bracing the faucet, one hand lifting the diverter at just the right speed and amount of force (and holding your mouth just right). Even then, it only fully engages about 30% of the time. And it doesn't return to the down position easily, impossible while water is on. The spout has been replaced twice now with no improvement, and the contractor says we need a different style/type of fixture, but doesn't provide a good explanation as to 'why'. We used a similar style (Ara) in another bathroom and it is working fine.

The suggested replacement is a traditional looking Delta pull up diverter spout, which seems to indicate that they think the fixture is junk - though I haven't been able to find any negative info about this Delta faucet online. What other factors could make a new diverter work sporadically? Valve, water pressure, something installation related?

I suggest you phone customer service at Delta. They have special powers. ;)
