Delta tub diverter keeps falling out? Please help

Everytime I pull down my shower diverter the water will run for a very short period of time from the shower and then the diverter just comes flying out. How can I get it to stay in? I have attached pictures of the diverter and spout I hope that helps.

Call Delta 1-800-345-DELT and they will replace the spout. Forget about fixing the diverter.

Did you look under the spout if there was or is a set screw?
