Can i run a vent pipe through the top plate? I don't think it is load bearing. Photo included

Hi please see the photo. The picture was taken in our guest bathroom. This is the sink vent pipe. This is inside the ferndown, below the attic. We are removing the ferndowns in this bathroom remodel but see it here. I want to run that vent pipe straight up through that top plate the arrow is pointing to. I am pulling down the ferndown and don't want to see that pipe. This is not a load bearing wall. I will put the 45 in the attic, not in the bathroom. Is it within code to do this?

Yes, if it's load bearing see IRC R602.6.1. If you are 100% sure it is not load bearing, then you don't need the strap specified there. But I question why it wasn't run the top plate originally in that case.

Thanks for your response. House was built in 85, not sure why it does this here...I believe the load bearing wall is the hallway that goes through the middle of the house and is 3 feet to the right of this pipe.
