Remodeling a stairway 'planter' area

Hi all,
Anyone who owns a split level will remember this area of the house, where the stairway goes to the bedrooms, and they fill the area with a 'planter' to make up the space to the side of the stairs.

Here's a shot of what came with the house in 1952, faux brick and all, and then my remake.

I also redid the stairway, in place, by going over the treads and stringers with solid oak and doing the risers with oak door skin.

The small grill is connected to a duct system I built that takes excess heat from my atrium room wood stove that is recirculated to the living room/dining room area.

Very nice but surely it needs a stair rail or two to be code compliant?
