You can't "wet vent" the sink using the drain from a fixture on the floor above. The sink should have its own vent extending either up through the roof, or tying into an existing vent at least 6" above the flood rim of the highest fixture on the floor above. Otherwise the flow of water from the tub could siphon the water from the sink trap.

Depending on your jurisdiction you may be able to get by with an air admittance valve as the sink vent, which might give you some more flexibility, but the separate venting solution is preferable. Check with your local inspector.
