bathtub drain won't shut off

I have a plunger type (tripwaste) bathtub drain which won't function to shut off the drain. I can easily remove it, and it appears to be in good condition.

First, I'm not sure how to adjust it properly. Is the "open" position supposed to be above or below the bathtub drain?

Second, is it possible that this is an unsuitable type? The drain pipes appear pretty standard. Since the drain has a cross member for screwing in a drain cover, I'm reluctant to change to a different type.
