There was a bill to amend the NYC Code to permit them in dwellings that are 3 stories or less. It was adjourned indefinitely in 2001.

That's the only express reference I could find. NYC still requires hardlines for toilet installations; braided stainless hose is technically not permitted, so you don't see it in new construction, and Home Depot sells a special version of the Delta Toilet with hardlines specifically because of this. And only recently were disposers permitted. The NYC Plumbing Code is amended with Vatican-like speed.

Big end goes to tank fitting. Chrome riser is bent and cut and attached to the compression fitting on the stop valve.

Why don't they allow flex
The stated reason would be that it is less likely to burst. And that would be a true advantage.

An unstated reason is that the metallic line is harder for the DIY.

Plumer installed the AAV right above the stack leading out of the wall for the drain, with the intent of the AAV to be buried in the wall

He might have put it there so it was hidden from the inspector! Those need an access panel or be out in the open because they WILL fail eventually and you'll need to replace it.
